Introduction

Tykans Group Inc. (“Tykans”, “we”, or “our”) values our relationship with you and considers the protection of Personal Data to be extremely important and is committed to using best practices to safeguard Website users' Personal Data. This privacy statement explains how we do this. 

We have created this policy in guidance with the laws of the Province of Alberta and the applicable laws of Canada. Your home jurisdiction may have laws that are more or less protective than Canadian legislation. 

“Personal Data” is information specific to you that can be used to identify you, such as your full name, email address, address, postal code, phone number, gender, culture, social identity, date of birth, health and financial information. Personal Data specifically does not include publicly available information such as business contact information, employment history, nor does it include information of an anonymous nature, such as the type and version of browser or operating system.

Your Rights and Responsibilities

The right to rectification. At any time, you can contact Tykans Privacy Officer to review and amend your Personal Data. You have the right to request that Tykans correct any information you believe is inaccurate. You also have the right to request Tykans to complete information you believe is incomplete. It is your responsibility to keep Tykans informed of any changes to your Personal Data.

The right to erasure. If you wish to withdraw your consent for Tykans use of your Personal Data, you must notify Tykans Privacy Officer, and cease using Tykans Website. This Privacy Policy is reviewed regularly and is subject to change without notice, and it is your responsibility to review it on a regular basis. Your continued use of the Website indicates your acceptance of any changes. This Privacy Policy is for informational purposes only and is not intended to, and does not, create any contractual or other legal rights in or on behalf of any party.

Use of Personal Data

Tykans collects Personal Data from its clients, prospects, partners, supply vendors, job applicants, and staff. We do not sell your Personal Data to anyone and only share it with third parties who are facilitating the delivery of Tykans services. These services may include but are not limited to:

Tykans retains the express permission to disclose Personal Data to the appropriate authorities if Tykans, in its sole discretion, has reason to believe that the safety of any person may be in jeopardy or that any unlawful act has been or may be perpetrated. 

Use of Personal Data

Consent

When you visit the Tykans Website, your web browser activity is tracked, which may include your IP address through cookies as consent is implied. Tykans will obtain your expressed consent to send you marketing emails or texts such as newsletters or promotions, from time to time. You may at any time withdraw your consent by notifying Tykans using the details at the end of this policy. All marketing emails contain unsubscribe links.

Tykans Website collects certain information that may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of the Tykans Website, including a history of the pages you view. We use this information to improve your experience on the Website by customising messages and content based on your use.

You may accept or decline the use of browser tracking cookies; however, without the use of cookies, the Website may not function optimally or not function at all if the browsing data is declined.

Tykans uses a variety of secure technologies and may be governed by business operations, legislative requirements or contracts with service providers to ensure your Personal Data remains protected. Personal Data is retained for the duration of your relationship with Tykans and for a period after our relationship has ended for historic and archiving purposes. Tykans may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law.

The protection of your Personal Data is very important to Tykans and we utilize physical, technical and administrative safeguards. Our security measures are updated and tested on an ongoing basis. Tykans restricts access to your Personal Data on a need-to-know basis and that those employees are trained and comply with confidentiality requirements maintaining the privacy and security of your information. Our employees are trained to report any suspected privacy breach to Tykans Privacy Officer.

For our EU customers, partners, and other stakeholders, you are protected under GDPR if you are a user accessing our services from the European Union (EU).

Where your Personal Data falls subject to GDPR, the collection, use, disclosure, storage, access to, release of, and correction to your Personal Data will be managed in accordance with this Privacy Policy and the GDPR.

Where applicable in accordance with the GDPR, consent requirements, the ability to withdraw consent, request access to, or a correction of, your Personal Data will be managed pursuant to our obligations as set out by this Privacy Policy and the GDPR.

Transfer of Data

Your information, including Personal Data, may be transferred and/or maintained on servers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. Your consent to this Privacy Policy followed by your submission of your Personal Data represents your agreement to that transfer. Tykans will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

In no event shall Tykans or any other party associated with this website and Tykans Website be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use or inability to use this website, including but not limited to damages for loss of profits, data, or other intangible losses. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.

We take every privacy complaint seriously and will make all reasonable efforts to resolve your complaint promptly. You can file a complaint with your local supervisory authority for data protection at any time, however we would like to be given the first opportunity to resolve your concern. Our Privacy Officer will investigate the complaint and determine whether a breach has occurred and what action, if any, to take.
